To the Manager, Records and Information / FOI Coordinator,

Pursuant to the British Columbia Freedom of Information and Protection of Privacy Act, I am requesting access to records concerning Richmond City Council Resolution R26/14-10, adopted on July 27, 2026, relating to the social-media/publication controversy involving Jason Liu and the direction to forward the matter to the BC Human Rights Tribunal.

The purpose of this request is to understand the factual record, materials reviewed, internal process, and actions taken by the City before and after Council adopted Resolution R26/14-10.

Date range

Please search for responsive records created, sent, received, or modified between:

July 20, 2026 and August 20, 2026.

For categories relating specifically to the preparation and adoption of Resolution R26/14-10, please prioritize records created before or during the July 27, 2026 Council meeting.

1. Records provided to Mayor and Council before the vote

Please provide copies of all records that were provided, circulated, forwarded, shown, summarized, or otherwise made available to the Mayor or any Councillor before Council voted on Resolution R26/14-10 concerning:

• Jason Liu;
• the article or social-media post that was the subject of the resolution;
• the AI-generated image associated with that publication;
• allegations that the publication or image was discriminatory, racist, hateful, or otherwise inappropriate;
• any response, explanation, correction, deletion, apology, expression of regret, or other remedial action by Jason Liu.

This request includes, where responsive:

• the complete original Chinese-language article or post;
• screenshots;
• excerpts;
• translations;
• summaries;
• news reports;
• social-media posts;
• emails;
• correspondence;
• briefing notes;
• staff notes;
• memoranda;
• attachments;
• links or other materials circulated to members of Council.

If the complete original publication was provided to Council, please identify when and by whom it was provided.

If an English translation of the complete publication was provided to Council before the vote, please provide that translation and any records showing when and by whom it was provided.

2. Preparation of Resolution R26/14-10 and Item 23A

Please provide records concerning the preparation, drafting, review, amendment, approval, or addition to the agenda of Item 23A and Resolution R26/14-10, including:

• drafts of the motion or resolution;
• proposed amendments;
• correspondence concerning the wording of the resolution;
• records identifying who drafted or requested the wording;
• records concerning the decision to add Item 23A to the July 27 Council meeting agenda;
• communications between members of Council and City staff concerning Item 23A or R26/14-10;
• staff briefing materials concerning the proposed motion.

I am not requesting information protected by solicitor-client privilege. Where a responsive record contains privileged material together with non-privileged information, please disclose the reasonably severable non-privileged portions as permitted by FIPPA.

3. Efforts to contact or obtain information from Jason Liu before the vote

Please provide records showing whether, before Council adopted R26/14-10, the City, Mayor, any Councillor, or City staff:

• contacted or attempted to contact Jason Liu;
• requested a copy of the complete publication from him;
• requested a translation of the publication;
• asked him for an explanation or response;
• informed him that Council intended to consider a motion concerning him or his publication;
• invited him to provide written or oral submissions;
• verified whether the disputed image or post had already been removed;
• verified whether he had already apologized, expressed regret, clarified his position, or otherwise responded publicly.

Please include relevant emails, correspondence, notes, records of telephone calls or meetings, and other responsive records.

If no responsive records exist for any of these categories, I would appreciate confirmation that no responsive records were located.

4. Information regarding the BC Human Rights Tribunal

Please provide records concerning the decision to include the following direction in R26/14-10:

“forward this matter to the BC Human Rights Tribunal for their review”

including records addressing:

• what was meant by “forward this matter”;
• what authority or process the City intended to rely upon;
• whether the City intended to file a formal human-rights complaint;
• whether the City understood itself to be making a referral, complaint, request for review, or some other form of communication;
• what documents or information the City intended to send to the Tribunal.

Please also provide copies of records showing any actual communication or transmission made by the City, Mayor, Council, Councillors, or staff to the BC Human Rights Tribunal concerning this matter, including:

• letters;
• emails;
• forms;
• attachments;
• acknowledgements of receipt;
• Tribunal responses;
• file or complaint numbers, if any;
• subsequent communications concerning the status of the matter.

If no formal complaint was filed with the BC Human Rights Tribunal, please provide responsive records that indicate what action, if any, was actually taken pursuant to this portion of R26/14-10.

5. Procedural fairness and legal or policy considerations

Without requesting the substance of any solicitor-client privileged legal advice, please provide any non-privileged records concerning whether the City considered:

• providing notice to Jason Liu before Council considered the motion;
• providing him an opportunity to respond;
• reviewing the complete publication before adopting the resolution;
• procedural fairness requirements when Council formally criticizes or makes findings concerning an identifiable private citizen;
• freedom of expression or Charter considerations;
• City policies, procedures, precedents, or guidelines governing Council resolutions that formally criticize identifiable members of the public.

If the City relies on solicitor-client privilege to withhold records in this category, please identify the existence, date, general type of record, and applicable statutory exemption to the extent permitted by FIPPA, without revealing privileged content.

6. Communications with third parties concerning the proposed Council action

Please provide communications received by or sent from the Mayor, Councillors, Mayor’s Office, City Clerk’s Office, or relevant City staff concerning the proposed Council response to Jason Liu's publication between July 20 and July 27, 2026, including communications advocating for:

• Council condemnation;
• an apology;
• referral or communication with the BC Human Rights Tribunal;
• another formal City response.

Personal information of private individuals may be severed as required by FIPPA. I am primarily seeking the substance of representations made to the City and the City's responses, rather than unnecessary personal contact information.

7. Records concerning the City's July 29 public statement

Please provide records concerning the preparation and approval of the City of Richmond's July 29, 2026 public statement relating to this matter, including:

• drafts;
• edits;
• approval communications;
• records identifying the officials or staff responsible for approving the final wording;
• records discussing whether to include or omit reference to the BC Human Rights Tribunal.

Preferred format and search

Please provide responsive records electronically in PDF or native electronic format where reasonably practicable.

For electronic records, I ask that the search reasonably include records held by or on behalf of:

• the Mayor;
• members of Council;
• the Mayor's Office;
• the City Clerk's Office;
• the City Manager's Office;
• Communications staff;
• any staff involved in preparing Item 23A or R26/14-10.

Relevant search terms may include combinations of:

“Jason Liu”, “Liu”, “R26/14-10”, “23A”, “Human Rights Tribunal”, “BCHRT”, “discriminatory”, “apology”, “Richmond Rise”, “54%”, “7.4%”

I recognize that FIPPA permits the severing of information that is lawfully exempt from disclosure. Where only part of a responsive record is exempt, please disclose the remainder of the record rather than withholding the record in full.

If any portion of this request is considered too broad or would result in a significant fee estimate, please contact me before processing so that I may narrow or prioritize the request.

Because these records concern the process by which a municipal government formally acted in relation to an identifiable private citizen and concern public accountability for an adopted Council resolution, I ask that any applicable discretionary processing fees be waived or reduced on public-interest grounds under section 75 of FIPPA.
